Not that the specifics of the law will make any difference in how the charter captians operate, or in how I operate my boat; but I am curious about the law.

Like many weekend-warriors, I am a long time boater and fisherman. I try to use good common sense when boating; I do my best to be safe; I try hard to be considerate of others boating/fishing.

With regard to the charter boats, I, like most other weekend-warriors respect the charter boats, the fact that fishing is their livelyhood, and that more often than not, I followed them to the good fishing spot. I think the charter captains forget, that someone else, generally, told them where the good spots are. I give-way to them out of courtesy and respect for their livelyhood, not what the law may or may not say, but as I stated above, I am curious about the law.

I am just tired of constantly giving-way to the charter captains, and then hearing them talk bad, on the radio, about the weekend-warriors. To my knowledge, I have never cut across another boats baits (I may have, but i am not aware of it.), talked trash about a charter vessel on the radio, and have never forgotten that most of what I have learned about fishing, I learned from others; including the good spots, which I try to share with others.

As what seems to be the norm; the last two times I have fished, I have been run-over, run-down, and run-through; all while giving-way to the charter vessel. A couple of years ago, while trying to land two large fish, I had a charter boat cut across our lines. Result: We lost both fish, and over $90 worth of baits, plus the reels had just been spooled, the day before, with 80# line. Lost over half the line, and had to have them respooled again. From the tangled lines, we did recover the charter boats dredge, which we promptly returned to him. Neither the captain nor the mate said they were sorry or thanks for returning the dredge. I just marked it up to bad manners and the cost of fishing.

Just recently, though I did not loose any gear, I had a charter boat cut across my baits. My son, while pulling 7 baits, brought the boat up on plane to save the baits. The spreater bar and bird, about $175, passed under the bow of the charter boat. Minutes before, I heard one of the charter captains talking trash about a 24 foot Albemarle.

By the way; I know several captains very well (socially as good friends), and I have fished with other captains that I do not know. I have never met a captain or mate that I did not like. I do not think either captain cut across my lines intentionally. They just made a mistake. I just wish they would show a little more respect to the weekend-warrior.

One possible solution is to take a video camera with you and use it the next time you are put in a similar situation. It will serve two purposes.

First, the captain or mate will most likely see you using it and it puts them on notice. No one likes their less than courteous actions being filmed. Secondly if it becomes really nasty or criminal you can turn the recorded video in to the Coast Guard and file a complaint against the Captain of said vessel.

If you are serious about it I would learn whatever navigation rules if any apply.

When Charter’s take the stance of Out of my way I fish for a living that is a nonstarter with me. A Commercial guy or Charter gets 7 days a week to fish and I may get one day if I am lucky.

Like you I will go out of my way to be courteous and try to give the benefit of the doubt to other fisherman as a confrontation is not really all that fun while I’m trying to relax.
